'Judicial Activism' is a term of opprobrium you apply to 

the Supreme Court when it reaches a decision you 

don't like.  The last time the Supreme Court wasn't 

accused of 'Judicial Activism' was just moments 

before the Constitution of the United States was 

ratified on June 21, 1788.
